End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you and Motion ("Motion," "we," "us," or "our") governing your installation and use of the Motion mobile application, website, and related services (collectively, the "App").

By downloading, installing, or using the App, you agree to this EULA. If you do not agree, do not download, install, or use the App.

Subject to your compliance with this EULA, Motion grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App for your personal, non-commercial use.

This license does not grant ownership of the App or any Motion intellectual property.

You agree not to, and not to allow any third party to:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to access source code
• Sell, rent, lease, lend, redistribute, or sublicense the App
• Bypass security or technical protections in the App
• Use the App for unlawful purposes or in violation of applicable laws

If you download the App through Apple App Store or Google Play, you acknowledge that this EULA is between you and Motion, and not with Apple or Google.

• Apple and Google are not responsible for the App or its content
• Your use of the App must comply with applicable app marketplace terms and permitted usage rules
• Apple and Google are third-party beneficiaries of this EULA and may enforce applicable provisions

We may provide updates, patches, or new versions of the App at any time. Updates may be required for continued use of some or all App features.

We may also modify this EULA from time to time. Continued use of the App after updates to this EULA become effective means you accept the revised terms.

The App, including all software, designs, logos, graphics, content, and trademarks, is owned by Motion or its licensors and is protected by intellectual property laws.

All rights not expressly granted to you under this EULA are reserved by Motion and its licensors.

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any term.

Upon termination, you must stop using the App and delete all copies in your possession or control.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTION DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP.

In all cases, Motion's total liability to you for all claims related to the App will not exceed the amount you paid (if any) for the App in the 12 months prior to the claim.

Your use of Motion is also subject to our Terms of Service and Privacy Policy, which apply in addition to this EULA.
