Terms of Service

Welcome to Motion. By downloading, accessing, or using the Motion mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Motion. We reserve the right to update or modify these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

You must be at least 16 years old to use Motion. By using the App, you represent and warrant that:

• You are at least 16 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You will not use the App for any unlawful or prohibited purpose

When you create an account with Motion, you are responsible for:

• Providing accurate, current, and complete information
• Maintaining the security and confidentiality of your account credentials
• Notifying us immediately of any unauthorized use of your account
• All activities that occur under your account

You may not share your account with others, and you must not create an account using false information or impersonate another person.

You agree NOT to:

• Cheat, manipulate, or falsify GPS data, running times, or performance metrics
• Use bots, scripts, or automation tools to gain unfair advantages
• Harass, threaten, or abuse other users
• Upload or share offensive, illegal, or inappropriate content
• Reverse engineer, decompile, or tamper with the App
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the App for commercial purposes without our permission
• Violate any applicable laws, regulations, or third-party rights

Anti-Cheat Policy: Motion uses automated systems and manual reviews to detect cheating and suspicious activity. Any attempt to manipulate GPS data, use fake locations, or otherwise gain unfair advantages will result in immediate account suspension or permanent ban.

IMPORTANT: READ THIS SECTION CAREFULLY. RUNNING AND PHYSICAL ACTIVITY INVOLVE INHERENT RISKS.

Motion is a fitness tracking app designed to help you improve your running performance. However, you acknowledge and agree that:

• Medical Advice: Motion is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any fitness program, especially if you have pre-existing health conditions.
• Physical Risk: Running, especially outdoor running, involves risks including but not limited to injury, exhaustion, dehydration, heat stroke, accidents, and in rare cases, death. You assume all risks associated with using the App and participating in running activities.
• Real-World Hazards: When running outdoors, always be aware of your surroundings, traffic, weather conditions, and terrain. Do not use the App in a manner that distracts you from safety.
• Personal Responsibility: You are solely responsible for your own safety and well-being. Listen to your body, stay hydrated, and stop immediately if you experience pain, dizziness, or discomfort.

BY USING MOTION, YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH RUNNING AND PHYSICAL ACTIVITY AND WAIVE ANY CLAIMS AGAINST MOTION FOR INJURIES OR DAMAGES ARISING FROM YOUR USE OF THE APP.

Motion offers competitive features including 5km battles, league rankings, and matchmaking systems. By participating, you agree that:

• All competition results are final and binding
• Rankings and leagues are determined by our algorithms and may change over time
• You will compete fairly and honestly without cheating or manipulation
• We reserve the right to disqualify or remove results if we suspect cheating or rule violations
• Rewards, badges, and achievements have no monetary value and cannot be exchanged for cash

Fair Play Expectations: Motion is built on a community of honest, passionate runners. Cheating ruins the experience for everyone. We take fair play seriously and will enforce strict penalties against violators.

Motion may offer premium features, subscriptions, or in-app purchases ("Premium Services"). If you purchase Premium Services:

Motion allows you to create and share performance cards, templates, and other content ("User Content"). By sharing User Content, you grant Motion a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with the App.

You agree that your User Content:

• Does not violate any laws or third-party rights
• Does not contain offensive, harmful, or inappropriate material
• Does not infringe on intellectual property rights

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

Motion and all related content, features, trademarks, logos, and designs are the exclusive property of Motion and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not:

• Copy, modify, or create derivative works of the App
• Use our trademarks, logos, or branding without permission
• Sell, rent, lease, or distribute the App to third parties

We reserve the right to suspend, restrict, or terminate your account at any time, with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Cheating, fraud, or abuse
• Harmful or disruptive behavior
• Suspected unauthorized or illegal activity

If your account is terminated for violating these Terms, you are not entitled to a refund of any paid fees. You may appeal a suspension or ban by contacting support@motionrunning.app.

You may voluntarily delete your account at any time through the App settings. Upon deletion, all your data will be permanently removed in accordance with our Privacy Policy.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Motion disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that:

• The App will be uninterrupted, error-free, or secure
• GPS or performance data will be completely accurate
• Defects will be corrected promptly

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE APP.

In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Motion, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Any User Content you submit or share

If you have a dispute with Motion, please first contact us at support@motionrunning.app to attempt to resolve the issue informally.

If informal resolution fails, any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), except where prohibited by law.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive your right to participate in class actions or class arbitrations.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

For users outside the United States, you may have additional rights under local laws. Nothing in these Terms affects your statutory rights as a consumer.

We may update these Terms from time to time. We will notify you of significant changes by posting a notice in the App or sending an email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
